Miliki 59 Bendera RMS, Dangker di Seret Ke Pengadilan

Oleh admin ---------------- Rabu, 31-Oktober-2007, 06:33:12 ---------------- AKIBAT memiliki 59 lembar bendera Republik Maluku Selatan (RMS), Daniel Malawau alias Dangker dijadikan terdakwa dalam kasus percobaan makar di Pengadilan Negeri (PN) Ambon, Selasa (30/10). ----------------- Dalam persidangan Jaksa Penuntut Umum (JPU) Patty Ali, SH menjerat terdakwa Dangker dengan pasal tentang makar. Dalam dakwaannya, Patty Ali mengungkapkan, terdakwa Dangker Malawau ditangkap petugas polisi pada Kamis (21/6) sekitar pukul 12.00 wit, dikediamannya yang terletak di Benteng Atas. ---------------- Terdakwa ditangkap bersama Romenus Batseran alias Man dan Benny Samangun. Ketika ditahan dan dilakukan penggeledahan, petugas menemukan 59 lembar bendera RMS, yang disimpan terdakwa dibawah kolong tempat tidurnya. ---------------- Tertangkapnya Dangker bermula ketika saksi Romanus batseran yang tengah berada di terminal angkot jurusan Passo bertemu dengan Mikael Pattisinay (DPO), kemudian Mikael meminta Romelus untuk menuju rumah terdakwa guna membantu membuat bendera RMS. ---------------- Setelah berada di rumah terdakwa, dan sementara membantu terdakwa membuat bendera RMS, kemudian datanglah Boyke Agustinus Manuputty ke rumah terdakwa dan menanyakan perihal perjuangan RMS. Beberapa saat kemudian datanglah Mikael Lambiombir ke rumah terdakwa. Melihat kedatangan Lombiombir, ketiganya lantas menghentikan pembicaraan mengenai RMS. ------------------ Setelah itu beberapa anggota polisi lantas datang ke rumah terdakwa dan J.K katipana lantas melakukan penggeledahan di dalam rumah terdakwa. Dari hasil penggeledahan, petugas menemukan 59 lembar bendera RMS ukuran panjang 50 centimeter dan lebar 31 centimeter serta dokumen-dokumen RMS. ------------------ Kepada petugas terdakwa mengakui bendera RMS tersebut akan dikibarkan pada saat perayaan Harganas. Dokumen-dokumen RMS itu disimpan terdakwa untuk dipelajari. JPU menjerat terdakwa dengan pasal 110 ayat 2 ke 3 KUHP dan pasal 106 yonto pasal 55 ayat 1 ke 1 KUHP. Sidang selanjutnya ditunda hingga kamis (8/11) dengan agenda pemeriksaan saksi-saksi.(rbb)

Pelebaran Jalan di Aboru, Dinas PU Hanya Ganti Rugi Pohon

Harian Siwalima – Ambon --------------- Ambon, Siwalima,- Dinas Pekerjaan Umum (PU) Provinsi Maluku hanya mengganti rugi pohon-pohon milik masyarakat yang tergusur akibat pelebaran jalan di Negeri Aboru. --------------- Hal ini diungkapkan Kepala Dinas PU Maluku, Anton Sihaloho, kepada wartawan di Kantor Gubernur Maluku, akhir pekan lalu. ---------------- Menurutnya, penggusuran kemarin dilakukan sepanjang tiga kilometer lagi. Nilai ganti rugi per pohon sudah ditetapkan oleh Bupati Maluku Tengah, Abdullah Tuasikal yang dituangkan dalam bentuk Surat Keputusan, tetapi dirinya lupa berapa nominal per pohon berdasarkan jenis pohonnya. Tim dari PU kata Sihaloho, saat ini sementara turun untuk menghitungnya. “Pohon saja yang diganti berdasarkan Surat Keputusan Bupati. ------------------ Pohon cengkeh sekian per pohon, nominalnya saya lupa, “ujarnya. Sementara pembangunan talud, kata Sihaloho, setiap tahun selalu ada. RMS-er gevonnist met 17 Jaar Gevangenis

(Verdict of 17 Years Imprisonment against RMS-Sympathizer ) ------------- Radio Baku Bae, 25-10-2007 ------------- Ambon: Tegen een sympathisant van het Front voor de Soevereiniteit van Maluku / Republiek der Zuid-Molukken (FKM/RMS), John Markus, is door de Rechtbank van Ambon uiteindelijk een vonnis geveld van 17 jaar gevangenisstraf met aftrek van voorarrest. Dit is gebeurd op de vervolgzitting op 25-10-2007. ------------- Dit vonnis is zo hoog uitgevallen, omdat het volgens de Rechtbank van Ambon onder voorzitterschap van mr. R. Anthon Widyopriono bewezen is, dat John Markus, alias Otty, zich schuldig gemaakt heeft aan staatsondermijning. -------------- In zijn uitspraak heeft de Rechtbank verklaard dat voor dit vonnis op basis van Art. 106 van het Wetboek van Strafrecht voldoende grond is. Dit heeft zowel betrekking op de persoon die de daad gepleegd heeft, als op de daad van de staatsondermijning zelf. -------------- De gedaagde John Markus, alias Otty, heeft wettelijk en overtuigend daden van staatsondermijning begaan door een poging te ondernemen om de RMS-vlag, ook wel genoemd de Koningsvlag, te brengen naar een plek om die te hijsen. De gedaagde is ook een recidivist, die al eens eerder van de Rechtbank in Ambon een gevangenisstraf van 1 jaar gekregen heeft voor een soortgelijk vergrijp. Dat was een jaar geleden. --------------- Uitgaande van deze juridische analyse verklaarde de Rechtbank, dat de gedaagde Otty wettig bewezen de artikelen 106 en 110 van het Wetboek van Strafrecht heeft overtreden, en komt hij op gevangenisstraf van 17 jaar met aftrek van voorarrest. --------------- Het vonnis van de Rechtbank is kennelijk twee jaar hoger dan die door de Officier van Justitie, mr. Grace Siahaya , was geëist in haar aanklacht, die ze enige tijd terug had voorgelezen, namelijk 15 jaar met aftrek van voorarrest. --------------- Na afloop van de rechtszitting riep de gedaagde John Markus, alias Otty, met luide stem dat de Rechtbank van Ambon niet rechtvaardig was met het uitspreken van het vonnis tegen hem. --------------- "De Rechtbank van Ambon heeft geen rechtvaardig oordeel over mij geveld; ik ben geen crimineel", schreeuwde hij. --------------- Enkele bezoekers schudden op de zitting hun hoofd toen ze het vonnis van de Rechtbank van 17 jaar gevangenisstraf hoorden, en ook zij vinden de uitspraak van de Rechtbank van Ambon niet rechtvaardig. --------------- "De straf die wordt geveld voor alleen maar een poging om de RMS-vlag te hijsen is een gevangenisstraf van 17 jaar, maar hoe zit dat dan met een terrorisme-zaak zoals die van Ustad Arsyad, waarbij een vonnis is geveld van slechts 15 jaar? En dat terwijl er in de terrorisme-zaak mensenlevens te betreuren waren. DE RECHTER IS ERG ONRECHTVAARDIG", mopperde een bezoeker na afloop van de rechtszitting.

Dat was gebeurd toen ze van het dorp Aboru vervoerd werden naar de Stad Ambon. Drie anderen van deze elf waren al eerder door de Politie aan de Justitie van Ambon overgedragen. ---------------- Volgens Salomon valt de overdracht van de zeven gedaagden met hun dossiers en het bewijsmateriaal aan het Gerecht samen met de beëindiging van de wettelijke hechtenistijd op 27-10-2007. Voordien zijn de genoemde zeven tjakaleledansers onderzocht en hebben ze in hechtenis gezeten op het Politiebureau van de Politie van het Ressort Ambon/Lease.

Persidangan terhadap pelaku pengibaran bendera Republik Maluku Selatan di hadapan Presiden Susilo Bambang Yudhoyono saat upacara Hari Keluarga Nasional (Harganas) di Ambon, Maluku, Juni silam, segera dilaksanakan. Belum lama ini tiga penari cakalele yang menjadi tersangka makar, yaitu Prejon Saiya, Marten Saiya, dan Jhoni Sinai, diserahkan ke Kejaksaan Negeri Ambon. Penyerahan itu disertai sejumlah barang bukti termasuk dua lembar bendera kelompok separatis tersebut. ---------------------------- Polisi menjerat tiga anggota RMS ini dengan tindak pidana makar yang ancaman pidananya maksimal hukuman mati. Sedangkan 38 anggota RMS lainnya, termasuk Jhon Riri yang diduga sebagai aktor intelektualnya, masih menjalani pemeriksaan di Markas Kepolisian Daerah Maluku. ----------------------------- Pada 29 Juni silam, para anggota RMS itu menyusup sebagai penari cakalele pada acara Harganas di Lapangan Merdeka, Ambon. Tujuh Penari RMS Segera Jadi Tahanan Kejari Ambon

23-Oct-2007, Sri Kartini Makatita, Radio Baku Bae – Ambon --------------------------- TUJUH pelakon tarian cakalele yang mempertontonkan Bendera Republik Maluku Selatan (RMS) di depan Presiden Susilo Bambang Yodhoyono saat perayaan Hari Gerakan Keluarga Nasional (Harganas) tanggal 28 Juni lalu di Kota Ambon, dipastikan Kamis (25/10) akan berubah status dari tahanan kepolisian menjadi tahanan Kejaksaan Negeri (Kejari) Ambon. --------------------------- Kepada wartawan di Ambon, Senin (22/10), penyidik pembantu Iptu Jak Salamon katakan, sebenarnya ada 11 orang peserta tarian liar yang berhasil diringkus Kepolisian Pula-pulau Ambon dan Pulau-pulau Lease, namun satu orang di antara mereka meninggal dunia karena tengelam akibat ombak yang menghantam seapd boad dan membuatnya terbalik, saat mengantar mereka dari Desa Aboru menuju Kota Ambon. Sedangkan tiga terdakwa diantaranya, sudah terlebih dahulu dilimpahkan ke Kejari Ambon. --------------------------- Menurut Salamon, pelimpahan ketujuh terdakwa beserta Berita Acara Pemeriksaan (BAP) dan barang bukti dari kepolisian ke kejaksaan ini, bertepatan dengan akan berakhirnya masa penahanan di kepolisian pada tanggal tanggal 27 Oktober mendatang. Vooral als ze Bambang of Guntur heten, lijken ze het voor de kiezen te krijgen. --------------- De kleine kerusuhan van 25-4-2004 in Ambon, die door het NKRI-veiligheidsapparaat en zijn milities is uitgevoerd, en die 40 doden en 200 gewonden heeft opgeleverd, heeft niet alleen de FKM-leider Moses Tuwanakotta negen jaar gevangenisstraf bezorgd, maar ze heeft ook tot het ontslag geleid van de KAPOLDA Maluku van dat moment, Bambang Sutrisno . Hij zou zijn werk niet goed gedaan hebben. ---------------- Nu in 2007 is het weer raak. Op 29-6-2007 heeft Pres. Susilo Bambang Yudhoyono de schrik van zijn leven gekregen, toen hij op een hoogtijdag van de NKRI een RMS-vlag voor zijn neus kreeg. Het heeft ook bijna de baan gekost van de huidige KAPOLDA Maluku Mohammad Guntur Ariyadi. Deze lag zwaar onder vuur omdat hij het 'tjakalele-incident' niet heeft kunnen voorkomen. Maar hij heeft blijkbaar een herkansing gekregen en mag nu de zware repressiecampagne tegen de RMS, die na 29-6-2007 op gang gekomen is, leiden. Al 50 à 60 RMS-ers heeft hij al achter de tralies. De rechtszittingen staan op het punt om te beginnen. ---------------- Nu wordt hij weer geconfronteerd met zeer onaangename zaken: twee RMS-gevangenen, namelijk John Syaranamual en Johannis Kipollo zijn uit de politiecel ontsnapt. Maar geen nood; maak maar van de nood een deugd, nu maar net doen alsof hij op zoek is naar Nus Malawauw, alsof niet iedereen weet dat deze op de bodem van de zee ligt, nadat hij door het NKRI-veiligheidsapparaat is gedood. Zo kan de NKRI niet worden aangesproken op de verdwijning van Nus Malawauw: een mist optrekken rond zijn verdwijning. ------------- Of heeft de Politie van Maluku misschien met dat doel opzettelijk John en Johannis laten ontsnappen? De kwaadaardigheid van het NKRI-systeem kent geen grenzen. Dat blijkt ook uit het bericht van Dokter Alex dat het apparaat RMS-gevangenen elektroshocks toedient. ------------- Selamat Berdjuang, ------------- 2. Foto verspreid van gevluchte RMS-er. -------------- 19-10-2007 --------------- Ambon: John Syaranamual, een lid van de separatistische organisatie Republiek der Zuid-Molukken(RMS), is ontsnapt uit het Huis van Bewaring van het Directoraat van Parate Troepen in het Gewest Maluku, en tot op dit moment spoorloos. Ter vergemakkelijking van de opsporing heeft de politie een foto met persoongegevens van de verdachte verspreid. De Politie van Maluku heeft John Syaranamual op de opsporingslijst gezet. Met behulp van deze foto hoopt de Politie dat de bevolking haar kan helpen met het opnieuw gevangen nemen van de verdachte. ----------------- John wordt ervan verdacht betrokken te zijn geweest bij een RMS-vlaghijsing van een groep RMS-separatisten in de tuinwijk Kewang, Ambon Stad. Hij is (opnieuw) ontsnapt, samen met vier medegevangenen. Zij waren op 13 oktober 2007 gearresteerd, maar na een dag waren ze alweer ontsnapt uit het Huis van Bewaring van de Politie van het Gewest Maluku. ---------------- 3. Verdachte RMS-Vlaghijsactie neemt de Benen. ---------------- 19-10-2007 ----------------- Ambon: Yohannes Kapilo , verdachte in een zaak van de RMS-Vlaghijsingen heeft afgelopen zondag de benen genomen vanuit politiecel van de Politie van het Gewest Maluku, Ambon, Maluku. Hij is er vandoor gegaan bij de wisseling van de wacht. Het Hoofd van Politie Brigade-Generaal Aditya Guntur, heeft op woensdag 17-10-2007 verklaard, dat Kapilo heeft kunnen ontsnappen als gevolg van onachtzaamheid van zijn agenten. ------------------ Yohannes Kapilo is in het dorp Mahia gearresteerd, samen met zijn kameraden Ferdinand Noya, Novid Adolf, IsakSaimena en Deni de Fretes. Ze stonden al vanaf vorig jaar op de opsporingslijst van de Politie van Maluku. De zaak waar het om gaat is, dat de vijf een complot gevormd hebben om in het tuindorp Kewang, Onderdistrict Nusaniwe, Ambon, de RMS-vlag, oftewel de Koningsvlag, te hijsen. ------------------- Tot op dit moment is de politie bezig de verdachten te onderwerpen aan een onderzoek. Zij worden sterk verdacht van betrokkenheid bij het hijsen van de RMS-vlag voor de ogen van President Susilo Bambang Yudhoyono tijdens de plechtigheden van de Nationale Familie Dag (HARGANAS) op het Merdekaplein, Ambon, Maluku in de maand juni van dit jaar. --------------- 4. Politie van Maluku zit achter twee gevluchte RMS-Activisten aan. ---------------- Antara; 20-10-2007 --------------- Ambon: De Politie van de Provincie Maluku kijken uit naar twee activisten van de separatistische RMS (Republiek der Zuid-Molukken), die uit detentie zijn ontsnapt, aldus een woordvoerder. ---------------- Het Hoofd van Politie van Maluku, Brigade-Generaal Mohammad Guntur Ariyadi heeft zaterdag jongsleden dit tweetal geïdentificeerd met John Syaranamual en Nus Malawauw, die bij verschillende gelegenheden de benen namen. ---------------- Syaranamual was op 13 januari jongsleden uitgebroken. Hij was betrokken bij een RMS-vlaghijsingsactie in 2006. Malawauw ontsnapte toen de politie hem op een speedboot had meegenomen om andere RMS-volgelingen op te sporen op het Eiland Haruku in Midden Maluku. ---------------- Syaranamual was op de opsporingslijst van gezochte personen van de Politie van Maluku gezet en Malawauw houdt, naar men aannam, zich verborgen in het Dorp Aboroe op het Eiland Haruku, zei hij. ----------------- De Politie hebben ook geprobeerd om Simon Saiya, naar verluidt de tijdelijke opvolger van Alexander Manuputty, op te pakken. Manuputty is de Executieve Leider van het RMS-georiënteerde Front voor de Souvereiniteit van Maluku(FKM), die naar de Verenigde Staten is gegaan nadat hij in 2004 uit de Cipinang gevangenis in Jakarta was weggelopen. ----------------- Over de personen, die betrokken waren geweest bij poging om de RMS-vlag te hijsen bij de niet op het programma staande dansopvoering tijdens de plechtigheden van de Nationale Familie Dag in Ambon op 29 juni jongsleden, zei Ariyadi dat de politie in totaal 44 van hen gearresteerd heeft na afloop van het incident. ----------------- De politiedossiers van 31 van hen zijn al aangeboden aan de Procureurskantoor voor verdere juridische afhandeling op de Rechtbank in Ambon, zei hij. ----------------- 5. Elektroshocks voor zes RMS-Strijders. ----------------- Brief van Dokter Alex Manuputty, 12-10-2007. ------------------ Aan allen voor wie dit belangrijk is, ----------------------- Tot op dit ogenblik worden steeds maar weer de 45 onschuldige Molukkers (Zuid-Molukse strijders, die in detentie zitten vanwege betrokkenheid bij het RMS-vlagincident op 29-6-2007), op brute wijze behandeld door het Detachement 88 van de Mobiele Brigade, bij wie ze in hechtenis zitten. ---------------------- Dit soort bruut geweld wordt ook uitgevoerd door terroristische types en vermomde militairen, die bij de RMS-strijders in een cel gestopt worden in de gevangenis van Waiheru, Ambon Stad. --------------------- Op donderdag 11 oktober, 2007, hebben een drietal personen, te weten La Musa , La Aliasa en Svanus Tuasun (een werknemer in de Waiheru Gevangenis) elektroshocks toegediend aan zes van de RMS-strijders, namelijk: Yordan Saiya, Johan Saiya, Arens Saiya, Ruben Saiya, Yohanis Saiya en Daniel Akihary. --------------------- Het komt vaak voor dat Indonesische daders dit soort smerige dingen met de RMS-gevangenen uithalen. Het is niet overdreven om te zeggen dat leden van de Indonesische politie en het Indonesische leger, en ook bewakers, geilen op dit soort sadistische acties, die absoluut tegen de mensenrechten ingaan. Ze hebben er kennelijk veel plezier in. --------------------- De President, Ministers, het Hoofd van Politie, de Opperbevelhebber van het Leger zijn heel goed op de hoogte van dit soort activiteiten, maar ze houden zich stil. --------------------- DIT IS HET INDONESISCHE VEILIGHEIDSAPPARAAT TEN VOETEN UIT! Manuputty who is in charge in fighting morally against Indonesia government come again pass by this letter with a view like this (I just take some of the facts) which is pretty important: ------------------- 01. Proclamation of Republic of Indonesia (RI), Jogya and its surroundings area: “We the people of Indonesia do hereby proclaim the independence of Indonesia, all matters pertaining to the transfer of power, etc will be carried out expediently and in the shortest possible time”. Jakarta August 17, 1945, On behalf of Indonesia people signed, Soekarno-Hatta, 02. United States of Indonesia (Federal State of Indonesia) is belong to the whole Indonesia people and not only for the benefit of RI = Article 3 Linggarjati Agreement: The United States of Indonesia shall comprise the entire territory of the Netherlands Indies with the provision, however, that in the case the population of any territory, after due consultation with the other territories, should decide by democratic process that they are not, or not yet, willing to join the United States of Indonesia, they can establish a special relationship for such a territory to the United States of Indonesia and to the Kingdom of the Netherlands. 03. Article 2.2 Transitional Measure of Round Table Conference (RTC): Each component state shall be given the opportunity to ratify the final constitution. In case a component state does not ratify that constitution, it will be allowed to negotiate about a special relationship towards the Republic of Indonesia and the Kingdom of the Netherlands. 04. Provisional Constitution of the Republic of the United States of Indonesia: Section 42: Pending the completion of the structure of the Republic of the United States of Indonesia as a federation of states of equal status and with equal right, the partners mentioned in section 2 shall possess equal right. Section 43: On the completion of the federative structure of the Republic of the United States of Indonesia the leading principle will be that the wishes of the populations of the territories concerned, expressed in freedom by democratic methods, shall be decisive as to the position in the federation ultimately to be taken up by these territories. Section 189: Each federal state would therefore be given an opportunity to agree to the constitution. However in case a federal state fails to agree to it, this state shall have power to negotiate on a special relation with the Republic of the United States of Indonesia and the kingdom of the Netherlands. 05. Muktamar Denpasar Bali December 24th 1946 of the Negara Indonesia Timur (NIT/Great East) in Section 5, paragraph 1 provides: “The State will afford the several national communities an opportunity for self determination by democratic methods and on the lines of regulations to be made by or on behalf of the Crown of the Netherlands in consultation with the State and will enable the communities remaining within the framework of Eastern Indonesia to lead their own national existence, including the right to have their own economic system. 06. The United Nations Commission for Indonesia (UNCI) or any other United Nations Agency shall observe in Indonesia the implementation of the agreements reached at the Round Table Conference (RTC). In other word: UNCI is a replace of United Nations itself which is responsible to what will happened and to what had done with regard to recapitulation to Indonesian Federation November 27, 1949 and its completion. 07. The Judgment of the Supreme Court of Justice for New Guinea, given on the 7th of March 1952: The Agreements were signed by the Government of the Kingdom of the Netherlands, the Government of the Republic of the United States of Indonesia, and by the United Nations Commission for Indonesia. The parties who have signed, not only to the agreements but to the obligations entailed. The parties who have signed must make legitimate efforts to enforce that to which they have agreed. 08. Indonesia in this case RI (Ir. Soekarno) violated the RTC with conquered the whole states (15) via military aggression started at march 1950 after recapitulation to the United States of Indonesia on 27th November 1949. 09. Decision Letter of South Moluccas Council, March 11, 1950, namely: The South Moluccas joint to the East Indonesia State (NIT)/Great East and Federal state of Indonesia conditionally, without prejudice to their right to withdraw from the NIT/Great East and Federal State in case the Government of NIT should fail to pay due regard to the interests of the South Moluccan. The NIT government at Makassar was officially notified of this decision and the then Prime Minister of Eastern Indonesia, the late Mr. Nadjamuddin daeng Malewa in his known political manifest of May 1947, expressed his high appreciation of this decision of the Council of the South Moluccas at one of the sittings of the Provisional Parliament of the NIT. 10. Proclamation of the South Moluccas’ Republic (RMS), April 25, 1950 in connection with aforesaid: “In order to comply with the positive will and demands of the people of the South Moluccas we hereby do proclaim the independence de facto and de jure of the South Moluccas with the political structure of a Republic without any political connection with the Negara Indonesia Timur (Eastern Indonesia) and the Republik Indonesia Serikat (Republic of the United States of Indonesia) on account of the fact that Negara Indonesia Timur (Eastern Indonesia) has proved unable to maintain either, its position as a Federal State in accordance with the Denpasar Regulations still in force or the Decision of the Council of the South Moluccas taken on March 11, 1947, whilst the Republik Indonesia Serikat (Republic of United Satates of Indonesia) is at present acting in violation of the Treaties made at the Round Table Conference and of its own Constitution”. Ambon 25th April 1950, for the Government of the South Moluccas: signed, J.H.Manuhuttu, President; A.Wairisal, Prime Minister 11. Indonesia in this case RI (Ir. Soekarno) annexed RMS through military aggression during thirteen years (July 13, 1950 to December 3, 1963) henceforth build the Unitary State of Indonesia (Negara Kesatuan/Neo Colonialism of RI), August 15, 1950 that is the worst than original/ever. 12. The Netherlands Prime Minister Drees impressed by public feeling in the Netherlands, where it began to dawn upon the people that the agreements of the Hague Round Table Conference were being flagrantly violated, even made bold to send the following telegram to the Indonesian Prime Minister Mohammad Natsir on 4th October 1950,…………..but the RI redoubled its efforts to overrun recalcitrant Ambon as soon as possible. Indonesian Government likewise informed Prime Minister Drees that the South Moluccas affair was an internal matter. 13. The tenth day of October the UNCI received a reply to their letter dated 6th October to Mr. Moh. Room LL.D. Foreign Secretary of Indonesia. In this reply Mr. Room states that the Indonesian Government regrets to be unable to consider the appeal of the UNCI to cease military operations in the South Moluccas. 14. Two reports had come in from the UNCI to Security Council of United Nations; one dated 11th October 1950 concerning a situation in the South Moluccas, while there is certainly not a situation but a dispute. The other report dated 28th 1950 had only been circulated among the members of the Council that morning where it concerned the mobilization and repatriation of the Dutch troops in Java. According to the points aforementioned, then the righteousness is coming out obviously: 01. Proclamation of RI Based on Atlantic Charter and also by Human Rights Covenant that said: “All people shall have the right of self-determination”. With respect to this, all people in the world understand it. 02. Both proclamation were the same even the proclamation of the RMS has a more value than RI because its proclamation based on the Council which is established of, by and for the South Moluccans, it is representative, democratic and legally, whereas RI declared by at will. At least, there were only two Republic in Indonesia Archipelago namely, RI, August 17, 1945 Jogya and its surroundings area and lawful/the best of RMS, April 25, 1950. Strictly warning to His Honorable President of RI, August 17, 1945, DR. Susilo Bambang Yudhoyono wherein the fact remains that we (the Moluccans) are not separatist by virtual of each proclamation history (RI and RMS) and the whole things above said. That is why Please return the South Moluccas Republic (RMS) Sovereignty immediately, because it is inviolable and there is not an iota of mistakes in it. 03. By virtue of Article 2.2 Transitional Measure of Round Table Conference (RTC), it is patently clear that the Round Table Conference Agreements gave the Moluccas people the prerogative to refuse incorporation into the Republic of the United States of Indonesia either by exercise of a negative vote in a pre-incorporation plebiscite or by refusing to ratify the Provisional Constitution. 04. The South Moluccans never definitively joined the Republic of the United States of Indonesia and moreover its representative body proclaimed the Republic of the South Moluccas before the present Indonesian Republic existed, it means that the RMS has never had any constitutional relations with the latter and thus there can be no question of a domestic/internal matter. This point must be an underlie reason and underlined as the only point to bring, to open, to discuss and to settle the RMS case in the body of United Nations. This is a privilege of the South Moluccans. One more important thing that the RMS case is still becomes a pending case during May 5, 1971 up to now. 05. Point 8 and 11 above mentioned is a starting point to bring terrible alteration in Indonesia from peace to become specter thus far just exclusively of Soekarno’s/Javanese acquisitive. 06. The refugees is keeping displace. 02. The victim of Harganas (National Family Day) has been achieved 45 merely indigenous of Moluccas with an inhuman treatment. 03. Police job in South Moluccas just hunting, arresting and torturing even killing the indigenous Moluccas civilian that is innocent. 04. Gradually genocide of Indonesia Government towards Moluccas indigenous people is still going on by all manner of dirty means. 11. And the like. ----------------------- There is not any word like this: that the United Nations and the Kingdom of Netherlands must be soon opened the RMS case and returned the RMS’ Sovereignty to the rightfully people because “All people shall have the right of self-determination”, and it was implicitly that the Moluccans have the right of self-determination, wherein it has really done. We the Moluccans appreciate the annual assembly of United Nations on the last two months (September and October 2007) and crashing expected good future for the Moluccans, with reference to our RMS’ sovereignty, which should be discussed in it. Last but not least, we the Moluccans entreat to the whole receiver of this letter stated as copy distributed, please put your healing touch towards the suffering of the Moluccans, please open and settle our case. Inhumane Treatment towards Moluccans involving RMS flag incident

To Whom It May Concern ------------------- Over, over and over again Indonesia through police (Detachment 88) and disguising army conducted savage treatment towards around 45 innocent Moluccans (in this case RMS/Republic of the South Moluccas fighters that involving in RMS flag incident started at June 29, 2007) up to now, in Detachment 88 custody. The same barbaric action also ever so often done by some of kind of terrorist and disguising army who is imprisoned together with RMS fighters at Waiheru penitentiary, Ambon city. On Thursday October 11, 2007 La Musa, La Alisia and Svanus Tuasun is an Official of Waiheru Penitentiary done Sort of electrocute towards six of RMS fighters aforementioned namely: Yordan Saiya Johan Saiya Arens Saiya Ruben Saiya Yohanis Saiya Daniel Akihary There has been a lot of time they (Indonesia’s doer) did the similarly dirty deeds to RMS’ prisoner. It is not exaggerated if I say that Indonesia’s police and army and whoever in charge as a guard is pretty yearning to do sadistic action against human rights. ANTARA News Nasional 01/10/07 13:58 -------------- Tiga Pelaku "Tarian Liar" RMS Siap Disidangkan --------------- Ambon (ANTARA News) - Sedikitnya tiga pelaku aksi "tarian liar" yang diperagakaan simpatisan separatis RMS saat perayaan Harganas ke-XIV di Ambon, 29 Juni lalu yang dihadiri Presiden Susilo Bambang Yudhoyono, siap disidangkan di PN Ambon karena telah dilakukan pelimpahan berkas dan tersangka ke pengadilan. ---------------- Kajari Ambon Daniel Palapia ketika dikonfirmasi ANTARA News, di Ambon, Senin, mengatakan, tiga tersangka atas nama John Sinay, Alex Malawauw dan Abraham Sinay sudah dilimpahkan ke PN Ambon sehingga tinggal proses persidangan guna mempertanggungjawabkan perbuatan makar tersebut. ----------------- "Kami memeriksa 10 Berita Acara Pemeriksaan (BAP) yang dilimpahkan pihak penyidik (Polres P.Ambon dan P.P.Lease-red), tiga di antaranya sudah dinyatakan lengkap (P21) dan telah dilakukan pelimpahan tahap kedua (tersangka dan barang bukti ke penuntut umum) untuk selanjutnya telah dilimpahkan ke PN Ambon, sedangkan tujuh lainnya dalam perampungan," tambahnya. ------------------ Tujuh tersangka perbuatan makar lainnya adalah Frejon Saiya, Pieter Saiya, Mersi Riri, Marthen Saiya, Melkianus Sinay, Philip Malawauw dan Stevi Saiya. ------------------ Pertimbangannya, 10 tersangka ini ada yang terlibat langsung peragaan tari cakalele (perang -red) padahal tidak ada dalam agenda acara panitia Harganas ke-XIV. ----------------- Selain itu, sebagian tersangka lainnya dijerat karena terlibat kegiatan rapat-rapat menjelang tarian cakalele itu diperagakan sehinga berakibat Kapolda Maluku, Brigjen Pol Gatot Guntur maupun Pangdam XVI/Pattimura, Mayjen TNI Sudarmaydi Soebandi dicopot dari jabatannya. ----------------- Kajari Ambon menegaskan, tidak melakukan "tebang pilih" terhadap siapapun oknum yang melakukan perbuatan makar terhadap keutuhan NKRI. ----------------- "Siapa yang bersalah harus mempertanggungjawabkan perbuatannya dan hukum ditegakkan sesuai ketentuan," tambahnya. ----------------- Yang menjadi masalah hingga saat ini adalah pimpinan eksekutif Front Kedaulatan Maluku (FKM) yang memperjuangkan kembalinya kedaulatan RMS sementara, Simon Saiya, masih menjadi buronan polisi di Maluku. --------------- Simon Saiya menggantikan pimpinan eksekutif FKM/RMS, Alexander Manuputty yang kini buron ke Amerika Serikat setelah melarikan diri dari LP Cipinang tahun 2004 lalu.(*) -------------------- Re: Tiga Pelaku "Tarian Liar" RMS Siap Disidangkan -------------------- Mana yang liar, cakalele tarian adat Maluku, atau Susilo Bambang Yudhoyono adalah president liar dalam territorial integritas Republik Maluku Selatan?
